Family of a Polish citizen

Marriage to a Polish citizen and family life in an unmarried partnership follow different legal grounds. For spouses, the key issues are recognition of the marriage under Polish law and its genuine existence. For a child, citizenship and an independent residence basis need checking first.

Conditions

What needs checking

Temporary residence for a spouse and assessment of other family situations.

  • For a spouse: a valid marriage to a Polish citizen, recognised by Polish law.

  • The relationship is genuine and supported by records and the circumstances of family life.

  • For a partner or child, the separately applicable procedure is identified.

Process

From your circumstances to the next step

  1. Identify the route

Your current status, purpose of stay and previous decisions determine the focus of the review.

  2. Gather evidence

Use the route-specific document list. Flag missing documents and inconsistencies in personal details.

  3. Prepare submission

Follow the authority's current procedure. Keep proof of submission; the applicant completes any required personal steps.

  4. Respond to requests

Check official correspondence, response deadlines and any need to update documents when circumstances change.

  5. Review the decision

Check its wording, subsequent obligations and, where necessary, the appeal procedure.

FAQ

Frequently asked questions

Does marriage automatically legalise my stay?

No. Residence rights need to be arranged separately and the procedure's conditions met.

Are the financial requirements the same as foreign-family reunification?

No. Different conditions apply to spouses of Polish citizens; the income, housing and insurance checklist cannot simply be copied.

Can I get permanent residence immediately after marriage?

Marriage alone is insufficient. Permanent residence has separate conditions and residence-history requirements.
